Care / Custody & Control: Why you should know about it

Hey Tony,
The sad thing is that after a short while, our battle cry falls on deaf ears(home owners, builders, etc.) For me it has been easier to not razor tempered glass. Here you go home owner, these are the reasons why… Sorry you have to deal with the garbage glass but if nothing else, you have been informed and left with glass unscratched by my company(cleaner, yet far from the way I would prefer to have cleaned it).

I actually have no problem explaining the need for a waiver and the fact that I’m not responsible for someone else’s defect. In the 7 years I’ve used a waiver I’ve only had 2 people refuse to sign it. Of course I didn’t work for them.

Thanks for all the feedback. I have no resolution in the situation yet. Still waiting on insurance board review on a possible diffrence in the reading of care/ custody & control interpretation. Attorney is chomping at the bit to take action against insurance company right now. I am really frustrated with this whole BS scenerio with insurance. It has me scared to let my guys do anything right now. What if one of my guys screw up a 50,000 deck powerwashing and it has to be replaced? It was in our Care/custody and control right? So I’m nailed there too. Why bother with insurance then? Take your chances, save the 2500.0 a month and bank it away and wait for the need. It’s all ridiculous. I did talk to The Guru of Scratched Glass about it and he said he could do all kinds of analysis on it but I got lost in all of his " it cost this for the first analysis, this much for the second , this much for the third blah blah blah." Might as well get a microscope out myself and take pictures. Be broke after the fight anyways. Good News you ask? The world didn’t end yesterday at least. Another day to fight this I guess.

Doug-Ster,

Great Post, highly educational coming from one who knows the in’s and out’s of the insurance industry…

Thanks !

Dangerous Dave

You guys that have had 25,000+ in claims. why did you continue working after you knew you were scratching the glass with your blades? Common sense tells me that if my razor blade is scratching the glass I will know it right away. If I eat 1 piece of glass OK but the whole building? Now thats operator error and just wanting to get paid. I have seen many windows that were already scratched up on Resi and commercial and i will always bring it up with the owner as soon as I notice an issue.Even with a waiver in place why woukld you continue scratching the windows for the sake of getting crud off them? Doesnt sound like the glass indusrties fault at all, just lack of responsible cleaning.

My agent just called me explaining the care custody and control thing and for 59 buck more a year and I am covered…As should everyone else on here!!! if you move a lamp and break it and don’t have ccandc insurance won’t cover it!!! liability won’t cover it.

The loopholes are bullschit!

This is a common misconception. When dealing w/ dirty glass you can’t tell a difference between the feel or sound of the dirt being removed as opposed to FD. On top of that FD scratches can be next to impossible to see except under the right lighting conditions. By the time you might see an issue you may have already done a couple dozen panes or you may never know. The only way a razor is scratching is if it’s rusty. And I agree that if someone is using a rusty blade the damage is on them.

The $59 per year doesn’t make sense to me from their perspective for the risk involved.

It a big problem.
