A friend of mine started a company in a different industry after working for someone else in the same industry. The previous employer tried to enforce a non compete but was ruled out. Apparently the US constitution gives us all “the right to pursue happiness.” Fed trumps State.
Non compete agreements are worth about as much as the paper they are printed on. Great scare tactic though.
It would be interesting to find out of the same was true for Canada.
Sounds right, though. Seems bogus.
This particular contract was drawn up by a well-respected, corporate law firm , and apparently they specialize in franchise law specifically, so this WC guy is pretty confident that he’s right.
Thankfully, I’ll never have to find out, since I will never have to do business with him.
