Joseph D Walters insurance claim

Has anyone had any experience with Joseph D Walters and an actual scratched windows claim? Did the insurance company (Liberty Mutual, I believe) go to bat for you if the claim was bogus? If the claim was justified, did your CCC endorsement cover you? Were you 80% covered for the total, or 100%? I need to make sure my rear end is covered in the future, and I wanted some input about actual experiences with this company. Thanks for the help, guys.

I’m looking to change insurance. I’ve heard a lot of good things about JW, but haven’t read anything about anyone actually having anecdotal experience with them when facing a claim for damaged glass. Anyone…???

This doesn’t directly answer your question, but it may help.

I had a claim made against me because one of my employees in trying to remove tape that he was asked to remove scratched up the tint.

8 windows had damaged tint that looked like scratch marks.

My insurance company (not JW) sent an adjustor who assessed the damage. He figured out who was to blame (our company) then he allowed me to choose who would replace the tint.

I chose the company that does the tinting for this pharmacetical store (and the 1500 they have in Canada) they replaced the tint.

My insurance company covered the full amount - $1000 (my deductible), minus depreciation (they don’t pay 100% because the tint wasn’t new, it was six years old)

They paid $3200 and I paid $1600.

The reason I posted this is that you are always on the hook somewhat. You must pay depreciation (not sure if that applies for scratched glass), and deductible, so you’ll always have to pay something.

They didn’t give me any problems claiming this.

Hello Simon ~ Let us further add to this converation regarding the coverage…

The Care, Custody and Control endorsement will pay for damages for which the “named insured” is found to be legally liable, up to the $25,000 per occurrence limit/$25,000 aggregate that we include in our policies. Deductible is $500 per occurrence. In the event that the windows were older or deteriorated to begin with, there may be depreciation assessed, because the principle of insurance is to indemnify the claimant or put them back in the same financial position as they were in prior to the loss. The insurance company will not provide brand new windows for ones that were in less than new condition before the named insured got there.

As far as will the company go to “bat for them if they are not at fault”? First and foremost…you have to have coverage to have defense. So without the Care, Custody and Control endorsement, you would also NOT have a defense.

I like this thread. I switched to JW last year and have not had to make a claim.

For 10 years another company was happy to take our money but when we went to make our first claim it was amazing how quick it was denied and how unhelpful they became.

Frankly left a horrible taste in my mouth. Hope to not have to make a claim with JW but shall we do so I hope the experience is different.

You bolded “legally liable”. So does this mean the contractor would have to go through the court process for JW to handle up to 25k?

What if a contractor admitted they caused the scratches?

Sorry this reply is late coming back to this discussion. Catching up now with the additional questions and comments generated the best I can. Hopefully this helps a bit more and I don’t sound too boring speaking insurance language!

The easy answer to your question is that the company would respond more if you have the CCC coverage than if you don’t.

But, there is no cookie-cutter answer to this question, and there shouldn’t be. Claims are handled on an individual basis. Every scenario is different and requires individualized handling, and that is how it should be. You want a company who will listen to the details rather than give the party line.

But the principal of claim adjustment is pretty standard. The general liability insurance policy most commonly used provides that the company “will have the right and duty to defend the insured against any ‘suit’ seeking damages” “the insured becomes legally obligated to pay” but “will have no duty to defend the insured against any suit. . .to which this insurance does not apply”. The duty to defend ends when any available monies to pay claims has been spent. However, the insurance company has full discretion regarding when to investigate, defend or settle.
