I would think that even if you have a waiver, people can still take you to court and you’ll still lose money even if you win. A waiver is more of a deterrent to keep people from considering the courtroom.

That is a consideration. However I would represent myself w/ the educational material out there and would only be out any work I may not be able to reschedule. They would have to carry the expense of their attorney. The waiver can also help you realize whether you are dealing w/ a reasonable person or not. If they expect you to work on a potentially defective product w/out a waiver then that should set off warning bells.
Do you just modify this waiver for residential or use it as is?
I’d have it checked out by an attorney in your area to make sure it’s worded properly for maximum protection.
I made a few changes, but that’s basically what I use. I have not shown it to a lawyer either, though I am in the same state as Dan Fields (I believe his was the basis for this.)
thanks goodness for my hard work reading over the forum! i’m soon starting my business. glad found this useful topic. and yes use wavier every time. economy these day people going take advance out of you. even you not the one to be blame but they sue you for the money and here goes 2000$ in their pocket and i’m sure they not going fix the window anyway so… Waiver SAVE LIFE!!!
is this waiver going be legal on any state ? and is it free to check on the attorney for the waiver? or there something behind it. and of course i understand nothing for free in life… i’m from garland texas

The waivers being offered need to be reviewed by an attorney in your area so that it will cover you specifically. Most likely the attorney will charge you for reviewing and maybe even modifying it.
so i cant use Dan Fields form for my own? it’s already check by his attorney isnt. if not then wow… i going have lots of problem writing with these type of form like satisfaction, damage waiver , estimate service agreement, comm agreement . cause i got some those form posted from somewhere on the wcr forum anyway thanks alot bro.
Dan is in California. Texas laws may be different. This has been been an issue because a defect and its liability is at stake.
Service agreements pretty much just need to be agreed upon by both sides – there must be “fair” consideration for both sides. Larger companies will most likely require you to use their contract forms. It’s not a big deal.
